What is Planning Permission? 

Planning is mainly in place to control land use. Uses are categorised with some land use categories being interchangeable (under the permitted development order) and some requiring planning permission to change the use. For example, Use Class C3 applies to a standard household and Use Class C4 applies to a property that is used by 3 – 6 unrelated people.

The Permitted Development Order Part 3 Class L allows C3 & C4 use to be interchangeable (subject to a few conditions). However, converting an F1 use (community use including a church) to C3, for example, would require planning permission. 
 
If your property has planning permission for C3 use, it is likely that it can also be used for C4 use. However, some councils restrict the use of HMOs (C4 use) with an Article 4 direction; this means that if you are in an area under Article 4, C3 and C4 use is not interchangeable, and you will need planning permission. 
 
What is a HMO License?
 
A HMO license demonstrates that your property meets the amenity and safety requirements for HMO use. However, a HMO license does not demonstrate that your property can be used for C4 HMO use – you will also need planning permission. 
 

If your C4 HMO was active prior to an Article 4 directive being put in place, it is unlikely that you will have to apply for planning permission. However, if you wish to sell your HMO or if you receive a Planning Contravention Notice you may have to demonstrate that your HMO was active prior to the Article 4 Directive. A certificate of lawful development will demonstrate your HMO is lawful and these are obtained through an application to your local authority.

Article 4 Directions are planning restrictions introduced by local authorities to control the concentration of Houses in Multiple Occupation (HMOs) in certain areas. Under normal planning rules, converting a house (a C3 dwelling) into a small HMO (a C4 use class, for 3–6 unrelated tenants) does not require planning permission—this is known as permitted development.

However, when a local council introduces an Article 4 Direction, it removes that permitted development right, meaning you must apply for full planning permission to convert a property into an HMO—even for 3 to 6 tenants.

If you wish to convert your property into a HMO within an area under an Article 4 Directive, you will have to submit a planning application. The determining factors may vary based on your local authority. In Bournemouth, Christchurch Poole (BCP) Council, it will have to be demonstrated that your proposal will not contribute to an overconcentration of HMOs (more than 10% of dwellings within 100m) and your proposal provides adequate parking & waste collection (as well as other criteria).
 
In a case where a HMO is intended for more than 6 people, it is considered a category of its own and no standard use category applies. For an HMO with more than 6 people, you will have to apply for planning permission regardless of your location. This type of HMO is called Sui Generis. The local authority will assess your proposal in its own merits and take into account several factors before issuing a decision.
 

With a change in use, the requirements of your building will change. It is likely that you will need to retrofit your property to meet the standards of the Building Regulations Act. Key things to consider are the transfer of sound and controlling the spread of fire (as well as other factors). HMO licensing is separate from planning permission. A license is also enforced by your local council and their requirements vary. The conditions of your license is based on the number of occupants and the type of tenancy agreement. Licensing involves inspections by local authorities of fire safety systems, property conditions, and amenities standards. HMO licenses are valid for a set time before you have to renew them.
 
If landlords obtain a HMO license it shows they are committed to maintaining high standards and legal obligations. If you don’t hold a license when you need one you could be faced with high fines.
